Terms of Service

These Terms of Service ("Terms") govern your use of the Demi app and related services ("Demi", "we", "us", "our"), operated from Melbourne, Victoria, Australia. By creating an account or using Demi, you agree to these Terms and to our Privacy Policy.
1. What Demi Is — and Is Not
Demi is a general wellness and lifestyle tracking app. It lets you record food, water, movement, weight, sleep, mood, and menstrual cycle information, and shows you trends and patterns computed from your own entries.
Demi is NOT a medical device, and nothing in the app is medical advice.
Information in Demi — including calorie ranges, cycle-phase content, predictions, and pattern insights — is general information only
Demi does not diagnose, treat, cure, or prevent any disease or condition
Cycle predictions are estimates based on the dates you enter and must never be relied on for contraception or conception planning
Always consult a qualified health professional before making decisions about your diet, exercise, medication, or health, and before acting on anything you see in the app
2. Health Conditions and Wellbeing
Demi is designed to be supportive for people managing conditions such as PCOS and endometriosis, but it is a tracking tool, not treatment. If you have a medical condition, work with your treating professionals.
If you have, or have a history of, an eating disorder, please take care: food and calorie tracking may not be appropriate for you, and Demi’s Diary and Mindful modes exist so you can use the app without visible numbers. Demi is not a treatment or recovery tool for eating disorders. If you are struggling, support is available — in Australia, the Butterfly Foundation (1800 33 4673) offers free, confidential help.
3. Eligibility and Accounts
You must be at least 16 years old to use Demi
You must provide accurate account information and keep your login credentials secure
You are responsible for activity that occurs under your account
One account per person; accounts are personal and non-transferable
4. Subscriptions, Trial, and Payment
Demi offers an annual subscription at AUD $49.95 per year (pricing in other regions is set by the app stores and may vary)
New accounts receive a 30-day free trial with full access. Your payment method is captured when the trial starts and charged when the trial ends, unless you cancel before then
Subscriptions renew automatically each year unless cancelled at least 24 hours before the end of the current period
All payments are processed by Apple (App Store) or Google (Google Play). Manage or cancel your subscription in your App Store or Google Play account settings — we cannot cancel it for you, and deleting the app or your account does not cancel a subscription
Refunds are handled by Apple and Google under their policies, alongside your rights under the Australian Consumer Law
5. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Competition and Consumer Act 2010 (Cth) or other applicable law that cannot lawfully be excluded.
6. Your Content and Data
You own the data you enter into Demi. You grant us a limited licence to store and process it solely to provide the service to you
You can delete your account and all associated data at any time in the app (Profile → Privacy → Delete account). Deletion is permanent
Our collection and handling of your data is described in the Privacy Policy
7. Food and Nutrition Data
Nutrition information in Demi comes from public and third-party databases (including AUSNUT-derived data, Open Food Facts, and USDA FoodData Central) and from entries created by you. Third-party and community-contributed data may contain errors, and products from other countries may have different formulations. Nutrition figures are estimates — verify against product packaging where accuracy matters to you.
8. Acceptable Use
Do not misuse the service, interfere with its operation, or attempt to access it by any means other than the app
Do not attempt to reverse engineer, scrape, resell, or redistribute the service or its data
Do not use Demi for any unlawful purpose
We may suspend or terminate accounts that breach these Terms.
9. Intellectual Property
The Demi app, name, design, and content (excluding your data and third-party database content) are owned by us and protected by law. These Terms do not grant you any rights in them beyond personal use of the app.
10. Availability and Changes
We aim to keep Demi available and reliable, but the service is provided "as is" and may occasionally be interrupted for maintenance, updates, or reasons beyond our control. We may add, change, or remove features over time. If we make material changes to these Terms, we will notify you in the app before they take effect.
11. Limitation of Liability
To the maximum extent permitted by law (and subject always to section 5), we exclude liability for indirect or consequential loss, and our total aggregate liability in connection with the service is limited to the amount you paid for your subscription in the 12 months before the claim arose. Nothing in this section limits liability that cannot be limited under Australian law.
You are responsible for decisions you make based on information in the app. See section 1: Demi is not medical advice.
12. Termination
You may stop using Demi and delete your account at any time. We may suspend or terminate the service or your account for breach of these Terms, with notice where practicable. Sections that by their nature should survive termination (including sections 1, 5, 9, and 11) survive.
13. Governing Law
These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of Victoria.
